What are the conditions for Early intervention in Article 27(1) of Directive 2014/59/EU (BRRD)?

The drafting is not clear. Member States are required to provide for a set of triggers which will form the basis for the supervisor’s assessment that the conditions for Early intervention are met. The EBA will provide guidelines on the triggers. We would appreciate clarifications on the consistent transposition of these requirements across Member States.

The EBA has published its Guidelines on triggers for use of early intervention measures on 8 May 2015, which are applicable to all Member States. While those Guidelines are helping in providing the possibility to achieve a uniform application of early intervention triggers, they cannot substitute judgement on the part of the competent authority which should take its responsibility.
